Terms

§1. General provisions

  1. The online store “Szczypta” operates at: www.szczyptameble.com (the “Store”).

  2. The Store is operated by: SZCZYPTA ZOFIA SZYMKOWIAK, Tax ID (NIP): 7791109256 REGON: 300310151 (the “Seller”).

  3. Seller contact details:

  4. These Terms & Conditions set out the rules for placing orders, concluding sales contracts, delivery, withdrawal from the contract, complaints, and electronic services provided within the Store.

  5. The Store sells within Poland and—where available in the Store—also to other EU countries (according to delivery options shown at checkout).

§2. Definitions

  1. Customer – a person purchasing in the Store: a Consumer, a Business Customer, or a Sole Trader with Consumer Rights (where applicable).

  2. Consumer – a natural person acting for purposes outside their trade, business or profession.

  3. Business Customer – a natural or legal person or an organisational unit purchasing in connection with their business activity.

  4. Sole Trader with Consumer Rights – a natural person running a business who purchases in connection with that business, but the purchase is not of a professional nature for them (where applicable under Polish law).

  5. Goods/Product – furniture offered in the Store.

  6. Refurbished Goods (renewed after renovation) – furniture professionally renewed based on an older piece, which may show minor, natural signs of previous use.

  7. Sales Contract – a distance contract concluded between the Customer and the Seller.

  8. Business Day – Monday to Friday excluding public holidays.

§3. Information about refurbished goods (important)

  1. The Store offers professionally refurbished/renewed furniture (based on older pieces). Each item may be unique.

  2. Due to the nature of refurbished goods, a product may show minor, natural signs of previous use (e.g. small scratches, patina, minimal differences in shade or texture). Such signs do not affect functionality.

  3. The product description and photos (including detail photos) as well as any listed features/marks are an integral part of the offer and the Sales Contract.

§4. Electronic services

  1. The Seller provides electronic services enabling use of the Store, including: browsing the assortment, placing orders via the cart/order form, and contacting the Seller via form/e-mail.

  2. To use the Store, the Customer needs: an Internet-enabled device, an up-to-date browser, and an active e-mail account.

  3. The Customer shall use the Store in accordance with the law and good practice, and provide truthful data.

  4. Complaints regarding electronic services may be submitted to: info@szczyptameble.com. The Seller will respond within a reasonable time, no later than 14 days.

§5. Placing orders and concluding the contract

  1. Orders are placed by adding products to the cart and completing the order form.

  2. Placing an order requires acceptance of these Terms & Conditions and acknowledging withdrawal information (where applicable).

  3. The Sales Contract is concluded when the Seller sends an order acceptance confirmation to the Customer’s e-mail address.

  4. The Customer confirms the order using a button clearly indicating an obligation to pay (e.g. “Order and Pay”, “Order with obligation to pay”, or equivalent).

§6. Prices and payments

  1. Prices shown in the Store are gross prices and do not include delivery costs (unless clearly stated otherwise).

  2. Delivery costs and the total order value are displayed during checkout, before final confirmation.

  3. Available payment methods are presented during checkout (e.g. bank transfer, online payment, card—depending on the Store’s current options).

  4. The Seller may offer promotions and discounts according to rules described in the Store.

§7. Delivery and order fulfilment

  1. Delivery is made to the address provided by the Customer, using the delivery methods available in the Store.

  2. Delivery/fulfilment times are stated in the Store (e.g. in the product description or during checkout).

  3. The Goods are considered delivered when handed over to the carrier (for shipped orders) or upon collection (for personal pickup, if available).

  4. The Customer should inspect the parcel upon receipt. If transport damage is suspected, the Customer should prepare a damage report with the carrier (if possible) and contact the Seller promptly.

§8. Right of withdrawal (returns) – Consumers

  1. A Consumer (and a Sole Trader with Consumer Rights, where applicable) may withdraw from the Sales Contract within 14 days without giving any reason.

  2. The withdrawal period starts from the day the Customer (or a person indicated by them, other than the carrier) takes possession of the Goods.

  3. To exercise the right of withdrawal, the Customer shall send a statement (e.g. by e-mail to info@szczyptameble.com). The Customer may use the model withdrawal form attached to these Terms.

  4. The Customer must return the Goods without undue delay, no later than 14 days from sending the withdrawal statement.

  5. The Seller will refund payments no later than 14 days from receiving the returned Goods or from receiving proof of return shipment (whichever occurs first).

  6. The Customer bears the direct cost of returning the Goods, unless the Store states otherwise.

  7. The Customer is liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

§9. Complaints (non-conformity of goods with the contract)

  1. For Consumers (and Sole Traders with Consumer Rights where applicable), the Seller is liable for non-conformity of the Goods with the contract under applicable law.

  2. Complaints should be submitted to: info@szczyptameble.com, including a description of the issue and the requested remedy.

  3. The Seller will respond to a Consumer complaint within 14 days of receipt.

  4. The Seller is not liable for features resulting from the nature of refurbished Goods if such features were clearly shown in photos and/or described in the offer and accepted by the Customer (e.g. minor signs of previous use presented in the listing).

§10. Business Customers (B2B)

  1. This section applies to Business Customers (excluding Sole Traders with Consumer Rights).

  2. The Seller’s liability towards Business Customers may be limited to the fullest extent permitted by law (e.g. excluding liability for lost profits).

  3. Any disputes shall be resolved by the court competent for the Seller’s registered seat, unless mandatory law provides otherwise.

§11. Personal data and cookies

  1. The Seller is the controller of personal data.

  2. Rules for personal data processing and cookies are described in the Privacy & Cookies Policy available in the Store.

§12. Final provisions

  1. These Terms are available in the Store in a form allowing saving, reproducing and printing.

  2. The Seller may amend these Terms for valid reasons (e.g. changes in law, payment or delivery methods). Amendments do not affect orders placed before the changes take effect.

  3. Matters not covered herein are governed by applicable law.
